さっそく闘おう。
オリコンが、ジャーナリストの烏賀陽弘道氏個人に対して五千万円の損害賠償を求める訴訟を起こした。雑誌『サイゾー』に載った烏賀陽氏のコメントによって、オリコンの「名誉が傷つけられた」と言うのである。
このオリコンの言動を私は次の文章で批判した。
● ジャーナリスト個人を対象にした高額訴訟の不当性 －－反ＳＬＡＰＰの論理
オリコンは異常な訴訟を起こしたのである。通常、このような場合は、出版社とジャーナリストの両者を訴える。しかし、オリコンは出版社を訴えずジャーナリスト個人だけを訴えた。
そして、その理由として次のようなものを挙げた。（この理由は、私がまとめたものである。実際にオリコンが発言している部分はカギカッコで明示した。）
烏賀陽氏は、その「発言」について「発言は自分が責任をもって行ったものと明言」している。奇妙な論法である。
……雑誌の電話取材に応えた場合、コメントしたジャーナリストが一定の「責任」をもっているのは当たり前である。しかし、ジャーナリストに「責任」があるからと言って、出版社に「責任」が無い訳ではない。出版社には、その「事実誤認に基づく」「発言」を広めた「責任」がある。両者には、別種の「責任」があるのである。オリコンは、なぜ、出版社の「責任」を問わないのか。誠に奇妙である。 オリコンは「発言の責任」と「出版の責任」を混同している。「発言の責任」を認めた場合でも、「出版の責任」を認めたことにはならない。「発言」を広めた「責任」を認めたことにはならない。オリコンの論法は間違っていた。オリコンは虚偽の論法を使っていたのである。（注）これは一例である。
オリコンの論法は虚偽だらけである。
これは、学問上の観点からはありがたいことである。
オリコンは、哲学的分析の素材をたくさん提供してくれたのである。
虚偽の論法の分析は、哲学の華である。論理的思考の華である。
虚偽の論法を分析することによって、虚偽の論法への対処法を学ぶことが出来る。
虚偽を発見し、適切に対処することは大切である。もし、それが出来なければ、騙されてしまう。騙されて、いつの間にか五千万円を払わせられてしまうことにもなりかねない。
また、虚偽の論法の分析によって、理論を作ることが出来る。間違いが間違いであることを明確にするためには、こちらが理論的にならざるを得なくなるのである。
次回以降、さらにオリコンの論法の虚偽を分析する。
（注）
哲学用語での「虚偽」とは、「間違った論証」のことである。
「虚偽」は、必ずしも悪意があることを意味しない。悪意がある場合と単なる間違いの場合との両方を含む語である。この点、注意が必要である。
それに対して、「詭弁」は「人を騙そうとする悪意を持っておこなう間違った論証」のことである。
「虚偽」と「詭弁」とは意味が違うのである。
