オリコンの訴状は言う。
なお、被告は、「『オリコンの数字はある程度操作が可能だ』というレコード会社員の話も複数聞いたことがあります。」などとして、第三者からの噂ないし風評を引用しているが、その場合であっても読む者をして、その内容たる事実が実在するとの印象を与えるのであるから、名誉毀損が成立することは明らかであり、これは裁判実務上も定着している。
実は、「オリコンの数字はある程度操作が可能だ」という話は、私も聞いたことがある。
オリコンに訴えられるから、書かない方がいい？
いや、絶対に大丈夫である。訴えられるおそれはない。
私が、その話を聞いたのは、オリコンの創業者の故・小池聰行氏からだからだ。
小池聰行氏はインタービューに答えて次のように言った。
－－ところが、レコードを買い占める会社があって、そのサンプル店のデータに操作の手を加えているでしょう。 「ええ、そうですね。現実にそういう会社があることも否定しません。……〔略〕……」 （『噂の眞相』１９８３年８月号）
小池聰行氏自身が「ええ、そうですね」と「操作」の存在を認めているのだ。
つまり、小池聰行氏自身が「オリコンの数字はある程度操作が可能だ」という事実を認めているのだ。
オリコンは、烏賀陽弘道氏を訴える前に、小池聰行氏を訴えるべきであろう。（原理的には。）
さらに、ＡＢＣプロモーションの会長の山田廣作会長は次のように言う。
「音事協の内部でも、オリコンのあこぎな商法に対する疑惑や非難の声が、日ごとに高まっている。」 「その〔レコード買い占め会社の〕一つに、かつてクロスオーバーという会社がありましてね。何百万か払えば二週目に三十位、三週目には二十位にしてみせるというわけですよ。そこで、実際にやってみたら、オリコンのヒットチャートはその通りになった。それから判断しても、おかしいと思うでしょう。」（『噂の眞相』１９８３年７月号）
山田会長、捨て身の告発である。
〈おれがチャートを操作しようとしたら、出来たぞ。だから、オリコンのチャートはおかしいぞ。〉と。（苦笑）
オリコンは、まず、山田会長を訴えた方がよかったのではないか。
オリコンが大切にしている「チャートの信用性」を疑わせる発言をしているのだから。
もちろん、これらは、１９８３年当時のことである。
しかし、山田氏の告発は、実名を挙げてのものである。実名を挙げて、自分がチャートを「操作」したと認めているのである。これは重要な証言である。
さらに、当時の社長である小池聰行氏自身が「操作」の存在を認めていたのである。これも重要な証言である。
だから、烏賀陽弘道氏は、小池聰行氏と同じことを言ったに過ぎない。「操作」が存在するという事実は、既に小池聰行氏が認めているのである。
オリコン創業者と同じことを言っただけなのに、烏賀陽氏は名誉毀損で訴えられたのである。
創業者の小池聰行氏の証言をオリコンは忘れてしまったのか。
誠に、不自然である。
オリコンは、何が何でも、チャートの「操作」は存在しないことにしたいらしい。（または、小池聰行社長の証言を忘れてしまうほど、記憶力に問題があるらしい。）
これは〈都合が悪い事実の存在自体を否定する〉虚偽である。

Hands down, Apple's app store wins by a mile. It's a huge selection of all sorts of apps vs a rather sad selection of a handful for Zune. Microsoft has plans, especially in the realm of games, but I'm not sure I'd want to bet on the future if this aspect is important to you. The iPod is a much better choice in that case.
