法律は自分で解釈しよう。
では、どのように法律を解釈すればよいのか。
法律の解釈を「文理解釈」と「論理解釈（体系的解釈）」に分けるのは、安定した考えである。（注）
１ 文理解釈……法文を語・文法の通常の知識に基づき解釈する
２ 論理解釈……法文を法的文脈を考慮して解釈する。「法的文脈」とは、法文の意図などである。つまり、法文で何を実現しようとしているかなどである。
法文の解釈においては、まず文理解釈をおこなう。日本語として普通に法文を解釈するのである。しかし、それだけでは、法文の意味が確定できないことがある。法文が二つの意味に解釈できる場合などである。その場合、論理解釈をおこなう。法文の意図などを考慮して、どの意味が正しいかを判断するのである。
まず、この二種類の解釈を意識すればよい。
次の法文を見ていただきたい。
選挙運動のために使用する文書図画は、次の各号に規定する通常葉書並びに第１号及び第２号に規定するビラのほかは、頒布することができない。（公職選挙法 第１４２条）
この法文を総務省（当時は自治省）は次のように解釈した。
ホームページの公開は「文書図画」の「頒布」である。
これは奇怪な解釈である。恣意的な解釈である。
許し難い。
では、どうすればいいのか。
総務省の解釈を覆す形で、上の二種類の解釈をおこなえばよい。文理解釈と論理解釈をおこなえばよい。
それをおこなったのが、次の二つの文章である。
１ 文理解釈……インターネット選挙になるべきだった選挙
－－あなたも公職選挙法に「違反」してみませんか
２ 論理解釈……インターネット選挙は公職選挙法違反か
－－「馬」は「自動車」か
１の文章で、私は次のように書いた。
ホームページの公開と「文書図画」の「頒布」とは、どう違うのか。ビラは読みたくなくても、新聞に折り込まれている。葉書も読みたくなくても、ポストに届いている。しかし、ホームページは、本人が望まなくては見ることはない。ホームページを見た人は、アドレスを自分で打ち込んだのである。または、リンクを自分でクリックしたのである。ホームページは、自発的に行動しなくては見ることが出来ない。
だから、「ホームページの頒布を受ける」という文言には、違和感があるのである。「頒布を受ける」のではなく、「ホームページにアクセスした」のである。「ホームページを見た」のである。
次のような比喩が正しい。
〈ホームページの公開は、選挙事務所内の資料室の公開である。〉
選挙事務所内に資料室ある。さまざまな政策の資料がある。その資料室は、一般に公開されている。そこに、自発的に閲覧希望者が来る。いろいろな資料を閲覧して、帰っていく。
おこなわれているのは、〈資料室の公開〉である。「文書図画」の「頒布」ではない。これは、公職選挙法に違反していない。
これは、文理解釈をおこなっているのである。法文を日本語として普通に解釈しているのである。「ホームページの公開」は、「文書図画」の「頒布」と言えるかを検討しているのである。通常の日本語では、「ホームページの公開」は「文書図画」の「頒布」とは言えないことを論証しているのである。つまり、文理解釈をおこなったのである。
私は、大筋でこの検討で十分だと考えていた。しかし、総務省は〈ホームページの公開が「文書図画」の「頒布」である〉という解釈を訂正しなかった。そして、なぜか、ほとんどの政治家がその恣意的な解釈に従っていた。
仕方がないので、念押しの文章を書くことにした。
２の文章である。
公職選挙法で規定外の「文書図画」の「頒布」を禁止したのはなぜか。「頒布」できる数を制限したのはなぜか。
公平な選挙活動を望んだからであろう。数の制限がなければ、お金を持っている者だけがたくさんのビラを「頒布」できる。これを不公平と考えたのであろう。
確かに、ビラをたくさん作るにはお金がかかる。たくさん作れば作るほど、お金がかかる。
しかし、ホームページの場合は、どうであろうか。アクセスが増えれば増えるほど、お金がかかるのだろうか。大筋でそんなことはないであろう。
ホームページでは、お金を持っている人だけが有利になることはない。

「文書図画」の「頒布」を禁止した意図は、〈公平な選挙の実現〉であろう。
この意図を基準に解釈すると、どうなるであろうか。ホームページの公開は〈公平な選挙の実現〉の妨げにはならない。お金を持っている人だけが有利にはならない。つまり、ホームページの公開を「文書図画」の「頒布」と解釈することは出来ない。
これは、論理解釈をおこなっているのである。法文の意図を解釈しているのである。
〈公平な選挙の実現〉という意図を基準にした場合、法文がどう解釈できるかを論じている。意図を基準にした場合、ホームページの公開を「文書図画」の「頒布」と解釈するべきではないことを論証した。つまり、論理解釈をおこなったのである。
既に、私は、文理解釈と論理解釈の両方をおこなった。
そして、どちらの解釈においても、〈インターネット上の選挙活動は禁止されていない〉ことを示した。
法律の解釈には、おおざっぱに言って、文理解釈と論理解釈の二種類がある。
この二種類を意識しよう。
この二種類の解釈をおこなっておけば、まず、だいじょうぶであろう。
裁判になっても。（笑）

例えば、碧海純一氏は次のように言う。
法の解釈については、伝統的に、「文理解釈」（grammatische oder buchstäbliche Auslegung）と「論理解釈」（logische Auslegung）とが区別されてきた。文理解釈とは、法文の意味を文法の知識およびその法文を構成する語の通常の意味の知識にもとづいて説明することであり、法文が十分に明晰で、複数の解釈の余地がないばあいには、解釈は原則として文理解釈に終始する。しかし、法文が不明晰であれば、その文理解釈上の可能な意味がなんらかの見地からさらに限定されねばならない。この限定操作は、まず、その法文のおかれている〈法的文脈〉の考慮によってなされる。「法的文脈」とは、その法文と他の関係諸法文との関連、法秩序全体のなかでその法文が占める相対的な位置、一般的にみとめられる法上の諸原理、法秩序に内在する統制目的、などである。このような法的文脈への考慮にもとづいて法文の文理上可能な意味に対して加えられる限定操作がいままで「論理解釈」とよばれてきたところのものにほかならない。しかし、文理解釈をふくめて、あらゆる解釈は当然論理的でなければならないから、「論理解釈」という名称は誤解をまねきやすい。むしろ、「体系的解釈」という名称のほうが適当であろう。〔傍点を山カッコに改めた。〕
