確信犯的構造

　選挙にインターネットを活用し続ける門真市議・戸田ひさよし氏に警察から「警告」が来た。公職選挙法違反の容疑である。

　しかし、戸田ひさよし氏は喜んでいる。

　普通、警察から「警告」を受けて喜ぶことはない。

　戸田氏が「確信犯」だからである。

確信犯
　宗教的教義や政治的信念を貫徹するためにあえて法を犯す犯罪であり，社会の変動期に政治犯罪として表われることが多い。確信犯人は，自己の行動が現行の法秩序に違反するという自覚は有しながら，より高い次元の法の理念を実現しようとする点で，犯罪動機を抑止する反対動機の形成が期待できないところに特徴がある。〔『ブリタニカ国際大百科事典　小項目版』〕
　
　確信犯とは、「信念を貫徹するためにあえて法を犯す」者である。「法を守ることは正しくない。法を犯す方が道徳的に正しい。」との信念を持つ者である。
　戸田氏は「確信犯」なのである。だから、「警告」が来ても喜んでいるのである。「警告」が来るのは、自分が正しい行為をした証拠なのである。
　厳密に言うと、戸田氏は確信犯ではない。インターネットの活用は公職選挙法に違反していないからである。総務省がそう解釈しているだけだからである。だから、「確信犯」とカッコを付けて表記した。
　しかし、戸田氏は、総務省・警察がそのような解釈をしていることを知っていた。知っていて、その解釈に従わなかった。「解釈に従わない方が道徳的に正しい。」という信念を持っていたからである。
　ここに確信犯的構造がある。
　
　実は、私も喜んでいる。
　次のような文章を書いたことがある。

　大阪府警も、やっと筋を通す気になったのであろう。
　「確信犯」を相手にするのは面倒なのである。
　その面倒をいとわず、大阪府警が頑張ってくださるのならば大変ありがたいことである。
　あえて火中の栗を拾おうとしてくださっているのである。
　大阪府警は「より高い次元の法の理念を実現」するための同志と言ってもいい。（笑）
　大阪府警の「英断」に期待する。

Microsoft has plans, especially in the realm of games, but I'm not sure I'd want to bet on the future if this aspect is important to you. The iPod is a much better choice in that case.
