裁判官は「思考をけちる」ものである。（注１）
実態を見てみよう。
自衛隊が合憲かどうかが争われた恵庭事件である。（注２）
北海道で酪農業を営んでいた野崎兄弟は自衛隊の演習用の通信線を切って逮捕された。野崎兄弟は、自衛隊の演習によって度重なる被害を受けていた。乳牛の乳の出が悪くなったり、子牛が生まれにくくなったりしたのである。さらに、抗議も無視されたため、指揮所と発射所との間の通信線などをペンチで切ったのである。これが自衛隊法違反とされ、野崎兄弟は起訴された。「防衛の用に供する物を損壊」したとされたのである。
弁護側は、四百人の大弁護団で「自衛隊は違憲であるため自衛隊法は無効」という論陣を張った。
ここに確信犯的構造がある。
つまり、次のような構造である。
わざと自衛隊法に違反することによって、裁判所を憲法判断に引きずりこむ。
自衛隊が合憲かどうかの判断せざるを得ないように裁判所を追い込む。
裁判官は困ったであろう。
合憲と判断しても、違憲と判断しても、大変な事態になってしまうのである。
違憲と判断すれば、国を敵に回すことになる。国を敵に回すのは恐い。
合憲と判断すれば、世論を敵に回すことになる。何しろ、四百人の大弁護団が結成されているのである。これも、とても恐い。
判断を下すことは出来ないのである。
こういう時、一般的におこなわれるのが、楽な道を探して「逃げ」ることである。何とか憲法判断をしなくて済む方法を探すのである。
裁判官はどう「逃げ」たか。
演習用の通信線は、自衛隊法の定める「防衛の用に供する物」ではない。
「防衛の用に供する物」とは、武器・弾薬・航空機のような対外的武力行使に使うものである。演習用の通信線はそのようなものではない。
だから、通信線を切った野崎兄弟は無罪。（注３）
えっ。無罪？
確かに、無罪ならば、憲法判断は必要ない。
まさに、とんちの世界である。（笑）
「裁判官、よく思いついたな。」と、笑ってしまう。（もちろん、笑い事ではないのであるが。）
一休さんレベルの凄いとんちである。
恵庭事件では、裁判官は見事に楽な道を探して「逃げ」た。
オリコン訴訟の場合は、どうであろうか。
綿引穣判決は、ジャーナリストの活動を不可能にする非常識な判決であった。既に、次の文章で詳しく説明した。

だから、この判決は、世界中のジャーナリストを敵に回すものである。
東京高裁が綿引穣判決を追認すれば、批判の嵐になるであろう。世界中のジャーナリストから批判されるであろう。もう既に、国境なき記者団から意見書も出ている。
● 国境なき記者団 駐日代表の意見書
世界中のジャーナリストが東京高裁の判決に注目することになる。それは、四百人の大弁護団より恐いのである。
裁判官は「逃げ」た方が賢明である。
烏賀陽氏は発言していない。
だから、無罪。
いいとんちだと思うのだが。（笑）

念のため書く。「思考をけちる」は事実の指摘である。この文脈では、裁判官の行為を批判する意味ではない。「楽な道を探して『逃げ』る」・「とんち」も同様である。事実として、そのような状態があるという指摘をしたに過ぎない。「楽な道を探して『逃げ』るから、悪い」と主張している訳ではない。
また、裁判官自身が「逃げよう」と意図しているとは限らない。だから、「逃げ」るとカギカッコを付けた。

「恵庭事件」を『小学館 スーパー・ニッポニカ 日本大百科全書』は次のように説明する。自衛隊の合憲・違憲が争われたにもかかわらず、判決は全くそれに触れない「肩すかし判決」であったことが分かる。
自衛隊法が民間人に適用された初の事件であり、4年間の全訴訟過程において自衛隊（法）の合憲・違憲が争われた。1962年（昭和37）12月11日北海道石狩支庁恵庭町（現恵庭市）の自衛隊島松演習場内で、牧場経営者野崎兄弟が演習用通信線数か所を切断した。演習場付近ではすでに1955年以来ジェット機の射撃訓練、大砲実弾演習によって難聴や家畜の乳量・受胎率低下などの被害が続いており、野崎兄弟はたび重なる抗議のすえ、万策尽きてこの挙に出たものであった。事件は当初通常の器物損壊事件として捜査されたが、63年3月札幌地検が自衛隊法第121条違反（防衛用器物損壊）として起訴するや、自衛隊の違憲性を問う裁判として注目を集めた。以降、判決まで40回にわたる公判で、多数の憲法学者と400人に及ぶ大弁護団が自衛隊違憲論を展開し、地裁の憲法判断が期待された。しかし67年3月の判決は憲法判断に触れず、両被告の行為が自衛隊法第121条の構成要件に該当しないとして無罪を言い渡した。検察側の控訴放棄で判決は確定したが、新聞は「肩すかし判決」と評した。
