前の文章で、裁判官が楽な道に「逃げ」る実例を示した。
とんちを使うのである。（笑）
しかし、とんちよりさらに楽な道がある。
和解させるのである。原告・被告を和解させれば、判決文を書く必要がなくなる。判決文を書くには労力がかかる。書かない方が楽である。
また、判決内容で批判される可能性もなくなる。
綿引穣判決は次のような厳しい批判を受けた。（私の文章である。笑）
● 東京地裁が〈ジャーナリズムなど消えてしまえ〉判決を出す
● 東京地裁・綿引穣裁判長のＳＬＡＰＰ（恫喝訴訟）容認論の虚偽
● オリコンが明言した「殺意」を無視する異常な判決
グーグルで「綿引穣」を検索すると、私の文章が４番目に出てくる。（2008年11月12日、現在）

もちろん、綿引穣判決を批判しているのは私だけではない。
多くの人が批判している。次の文章で紹介した。

これは、綿引穣裁判官にとって嫌な事態であろう。
判決文を書くということは、裁判官が主体となって行動することである。主体となれば責任が発生する。それは、ある意味「汚れ仕事」である。「汚れ仕事」を原告・被告がやってくれれば、それにこしたことはない。
裁判官は、判決文を書きたがらない。和解させたがる。
そういうインセンティブが働いているのである。
