多くの人に見落とされている事実がある。
オリコンが烏賀陽弘道氏に訴状を送りつけてくるまでの過程である。
訴状が届く前に、烏賀陽氏はオリコンに取材を申し込んでいるのである。つまり、次のような形式になっている。
取材しようとしたら、訴状が届いた。
これはある種の基本形である。
言論の自由を妨害する典型的な形式なのである。
秘密に迫ろうとしたジャーナリストが消される。
国家の秘密に迫ろうとしたジャーナリストが消される。闇社会の秘密に迫ろうとしたジャーナリストが消される。
これと同じ形式なのである。
〈オリコンの秘密に迫ろうとしたら、高額訴訟で恫喝された〉という形式なのである。（注１）
烏賀陽氏は『サイゾー』誌の電話取材に答えた。その結果、納得のいかない文言を「コメント」として載せられてしまう。
そこで烏賀陽氏はオリコンに取材を申し込む。
１ 「コメント」が納得のいかないものだったので、きちんと取材したいと思いオリコン広報部に取材を申し込む。すると、「えっ？烏賀陽さん？ 後で担当の者から電話をさせるので、待っていて欲しい。」と言われる。
２ なぜか、広報部からではなく弁護士から電話があり、質問内容をＦＡＸで送るように言われる。
３ 質問内容を弁護士にＦＡＸで送る。
４ しかし、ＦＡＸへの回答は無く、内容証明が届き、訴状が届く。
つまり、取材への「答え」として訴状が届いた形になっている。
この過程は、うがやテレビで烏賀陽氏自身が詳しく語っている。

なぜ、オリコンは烏賀陽氏の取材に応えなかったのだろうか。
烏賀陽氏の「コメント」とされる文言が間違っているならば、その時に訂正を要求すればよかったのである。
オリコンは、それをせず、いきなり訴訟を起こした。これでは、「よほど調べられたくないことが質問内容の中にあったのであろう」と疑われても仕方ない。「秘密を隠すためにジャーナリストを消そうとしている」と疑われても仕方ない。
取材のＦＡＸに、訴状で「答える」会社はそうはないであろう。（苦笑）
やはり、オリコンはヤクザ企業なのであろうか。（注２）

烏賀陽氏には、報道被害者としての側面もある。電話取材に応えただけなのに訴えられたのである。

With havin so much content and articles do you ever run into any problems of plagorism or copyright violation? My blog has a lot of exclusive content I’ve either written myself or outsourced but it appears a lot of it is popping it up all over the internet without my agreement. Do you know any methods to help stop content from being stolen? I’d genuinely appreciate it.

Good points…I would note that as someone who really doesn’t comment to blogs much (in fact, this may be my first post), I don’t think the term “lurker” is very flattering to a non-posting reader. It’s not your fault in the least , but perhaps the blogosphere could come up with a better, non-creepy name for the 90% of us that enjoy reading the content .
