竹原信一 阿久根市長は、阿久根市議選の立候補者について言う。
その他に○○などは領収書詐欺容疑（領収書偽造を本人も認めた）で送検された状態での立候補、他にも送検されなかっただけで同じ事をした人間も居る。
今回は誰が議員としての仕事が出来るかというよりも、市民がどれだけ悪くないのを選べるかという選挙だ。これで粗大品は整理される。
● 2009/03/13 (金) お掃除選挙
確かに「粗大品は整理」した方がいい。
公費の「領収書偽造」をおこなった前市議は「粗大品」である。
落選させたい。
しかし、上の文章では、前市議の名前が「○○」と匿名になっている。だから、この文章を読んでも、誰を落選させたらいいのかが分からない。残念である。
ここで、竹原信一市長によいお知らせがある。
落選運動は公職選挙法違反ではない。
「○○」氏の実名を公表してもいいである。
実名を公表したとしても、それは「落選運動」だからである。
公職選挙法は「選挙運動」について規定している。しかし、「落選運動」は「選挙運動」ではない。つまり、公職選挙法には「落選運動」についての規定は無い。
「選挙運動」は〈特定の候補の当選を目的にする運動〉である。「落選運動」は〈当選を目的にする運動〉ではない。〈特定の候補の落選を目的にする運動〉である。公職選挙法の定める「選挙運動」に「落選運動」は含まれないのである。
だから、「粗大品」の実名を挙げても問題はない。
それでは、私が実名を挙げよう。
「○○」氏とは的場真一氏である。
「落選運動」ならば、実名を挙げても何の問題もない。「的場真一候補を落選させよう。」と書いても何の問題はない。
太田光征氏は言う。
１２日に、総務省選挙課に問い合わせたところ、公職選挙法には個人による落選運動を禁止する規定はない、ただし２人が立候補していて、結果的に一方の当選に利する行為であれば、選挙運動になることがある、という旨の回答をもらいました。

総務省も「落選運動を禁止する規定はない」と認めている。（注１）
もちろん、総務省が認めようが認めまいが、「選挙運動」の意味は変わらない。「選挙運動」に「落選運動」は含まれない。
しかし、総務省が認めているならば、心配性の人も安心であろう。（注２）
せっかくの「お掃除選挙」である。
「粗大品」はたくさんゴミに出した方がいい。
そのために「落選運動」は有効な手段である。

解釈は、最終的には司法が決めるのである。
「落選運動」の場合は、次のような判例がある。（上の文章を参照。）
単に特定候補のみの落選〔を〕はかる行為は選挙運動とはいえない

これではっきりした。「落選運動」は「選挙運動」ではない。
しかし、インターネット上の「選挙運動」については、司法において解釈が定まっていない。判例が無いのである。
〈選挙期間中にブログを更新したら公職選挙法違反である〉というのは総務省の恣意的な解釈に過ぎない。
詳しくは、次の文章をお読みいただきたい。
● インターネット上での選挙活動は禁止されていない
〈公職選挙法でブログ更新は禁止されていない〉と解釈する方がずっと自然なのである。

「お上」に「問い合わせ」をする行為には悪い影響がある。
次の文章で論じた。
● 「お上」に「お伺い」を立てる愚
● 〈問い合わせ〉行為自体が相手の行動を変えてしまう
しかし、「問い合わせ」には別の影響もある。太田光征氏は、総務省から「落選運動を禁止する規定はない」との見解を引き出した。
これは有効である。「お上」の「お墨付き」があれば、心配性の人でも安心できるのである。

Hands down, Apple's app store wins by a mile. It's a huge selection of all sorts of apps vs a rather sad selection of a handful for Zune. Microsoft has plans, especially in the realm of games, but I'm not sure I'd want to bet on the future if this aspect is important to you. The iPod is a much better choice in that case.

The new Zune browser is surprisingly good, but not as good as the iPod's. It works well, but isn't as fast as Safari, and has a clunkier interface. If you occasionally plan on using the web browser that's not an issue, but if you're planning to browse the web alot from your PMP then the iPod's larger screen and better browser may be important.

兵庫県で民主党から県議会議員に立候補してます。
実は今その人と離婚協議中＆別居中です。
でも、知らぬ合間に兵庫に引っ越し立候補してました。
なんとまあ身勝手な人間なのです。
正直、性格も自分勝手、自分の利益になることしかやらない、
口では誰にも負けないと豪語している口先だけの人、絶対当選などしてほしくありません。
離婚してから選挙に出てくれ～と思います。

今の民主党のだめさ、自民のふがいなさを考えるとみんなの党にも見込みがあるのかと思うとぞっとします。
新人でお金の援助があり、裕福だから選挙活動もできることに腹立たしさを覚えます。

上の方に、名誉毀損のことを書いてるコメントがあるが、これは心配ないと思う。
なぜなら、名誉毀損罪は刑法２３０条だが、刑法２３０条の２（公共の利益に関する場合の特例）は、仮に名誉を毀損する行為があっても、それが公共の利害に関する事実（例えば公務員や選挙の候補者などの過去の犯罪的行為など）に関して公益目的で行われ、その公表された事実が真実であるときは、違法ではない、と規定しているからだ。
むしろ、候補者の過去の犯罪的行為を公表することは、国民や市民の知る権利に寄与することであり、民主主義にとって望ましいことである。
