戸田ひさよし議員が失職した。公民権停止２年間の罰を受けたのである。
トップ当選を果たした議員が失職するのは前代未聞の事態である。
重要な事実がある。
戸田ひさよし氏は、有罪判決が出た後の選挙でトップ当選している。
つまり、有権者は、戸田ひさよし氏がどのような罪に問われたかを知っていた。知った上でトップ当選という判断を下したのである。
言わば、門真市民は戸田ひさよし氏に「無罪判決」を下したのだ。公民権停止を認めなかったのである。
しかし、この「無罪判決」を否定する形で最高裁の判決が出たのである。
つまり、次のような形になっている。
有権者の判断より、裁判所の判断が優先されている。
はたして、これでいいのだろうか。
なぜ、裁判所は有権者の判断を否定できるのか。
なぜ、公民権停止という罰があるのか。議員になることを禁止する罰があるのか。
議員になる資格があるかどうかは有権者が判断すればいい。
選挙という判断の機会があるのである。悪いことをすれば、有権者が議員の資格が無いと判断する。その候補者を落選させる。それでいいではないか。
これが民主主義の原理である。
なぜ、有権者の判断を否定する公民権停止という罰があるのか。
それは、「有権者がバカだ」と考えているからである。
公民権停止は「有権者はバカだ」という考えを含意する罰である。
〈有権者はバカなので、落選させるべき議員を当選させてしまう〉と考えているのである。だから、有権者が選んだ議員を失職させるのである。また、立候補できないようにするのである。議員になる資格を停止するのである。〈有権者は適切な選択を出来ないので裁判所が助けてやる〉という訳である。
門真市民はバカ扱いされたのである。
戸田ひさよし氏に投票した有権者はバカ扱いされたのである。
怒るべきである。
議員を自分で選ぶのは当然のことである。
バカな選択をしたとしても、その結果を自分で引き受ければいい。
民主主義とは〈自分達の責任でバカな選択肢を選ぶことが可能な制度〉なのである。前もって、誰かが選択肢を選んでくれる制度は民主主義ではない。
確かに、私達はバカかもしれない。
しかし、私達はバカ扱いされない権利を持っている。
それが民主主義なのである。

The new Zune browser is surprisingly good, but not as good as the iPod's. It works well, but isn't as fast as Safari, and has a clunkier interface. If you occasionally plan on using the web browser that's not an issue, but if you're planning to browse the web alot from your PMP then the iPod's larger screen and better browser may be important.

It's very colorful and lovely OLED screen is slightly smaller than the touch screen, but the player itself feels quite a bit smaller and lighter. Apple now has Rhapsody as an app, which is a great start, but it is currently hampered by the inability to store locally on your iPod, and has a dismal 64kbps bit rate. If this changes, then it will somewhat negate this advantage for the Zune, but the 10 songs per month will still be a big plus in Zune Pass' favor.
