公職選挙法に｢同一略称を禁ずる規定」はある。（注１）
……〔略〕……名称及び略称は、第86条の６第６項の規定による告示に係る政党その他の政治団体にあつては当該告示に係る名称及び略称でなければならないものとし、同項の告示に係る政党その他の政治団体以外の政党その他の政治団体にあつては同項の規定により告示された名称及び略称並びにこれらに類似する名称……〔略〕……以外の名称及び略称でなければならない。

非常に分かりにくい。
簡単にまとめると次の通りである。
１ 政党は、届け出た略称を使わなくてはならない。
２ その他の団体は、それと同一の略称を使ってはならない。
政党以外の団体については、｢同一略称を禁ずる規定」があるのである。しかし、政党についてはそのような規定は明文化されていない。（注２）
この条文をどう解釈するべきか。
弱小政治団体が大政党と同じ略称を使って利益を得ようとすることを禁じたのである。
それでは、政党については、なぜ｢同一略称を禁ずる規定」が明文化されていないのか。
政党が別の略称を使うのは当たり前だからである。
政党が他の政党とは別の略称を使うのは当たり前である。政党ならば、他の政党との混同を避けたいと願うのが普通である。だから、別の略称を使う。
それため、｢同一略称を禁ずる規定」が明文化されていないのである。
それでは、明文化されていないからといって、政党が｢同一略称」を使ってよいのか。
既に、政党でない政治団体については禁じられているのである。
それが、政党にだけ認められるのは誠に不自然である。政党だけに｢同一略称」を認める理由が思いつかない。
つまり、公職選挙法の趣旨との関係で条文を解釈するべきなのである。文理解釈だけでなく、論理解釈をおこなうべきなのである。（注３）
公職選挙法の趣旨を見てみよう。第１条｢この法律の目的」を見てみよう。
この法律は、日本国憲法の精神に則り、衆議院議員、参議院議員並びに地方公共団体の議会の議員及び長を公選する選挙制度を確立し、その選挙が選挙人の自由に表明せる意思によつて公明且つ適正に行われることを確保し、もつて民主政治の健全な発達を期することを目的とする。
｢公明且つ適正に行われることを確保し」とある。つまり、投票する人の意志が｢公明」｢適正」に表せる｢制度」を｢確保」することが公職選挙法の趣旨である。
この趣旨に照らせば、｢同一略称」は認めるべきではない。｢同一略称」では、その略称を書いた人の意志が分からなくなる。どの党に投票したかが分からなくなる。それでは、投票する人の意志が｢公明」｢適正」に表せる｢制度」ではなくなる。
それは、公職選挙法の趣旨に反する状態である。
公職選挙法の趣旨との関係で条文を解釈した。
政党についても、公職選挙法によって｢同一略称」の使用は禁じられている。
明文の規定が無いのは、当たり前だからである。
こう解釈する方が自然なのである。

The new Zune browser is surprisingly good, but not as good as the iPod's. It works well, but isn't as fast as Safari, and has a clunkier interface. If you occasionally plan on using the web browser that's not an issue, but if you're planning to browse the web alot from your PMP then the iPod's larger screen and better browser may be important.

The interface is colorful, has more flair, and some cool features like 'Mixview' that let you quickly see related albums, songs, or other users related to what you're listening to. Clicking on one of those will center on that item, and another set of "neighbors" will come into view, allowing you to navigate around exploring by similar artists, songs, or users. Speaking of users, the Zune "Social" is also great fun, letting you find others with shared tastes and becoming friends with them. You then can listen to a playlist created based on an amalgamation of what all your friends are listening to, which is also enjoyable. Those concerned with privacy will be relieved to know you can prevent the public from seeing your personal listening habits if you so choose.

Apple now has Rhapsody as an app, which is a great start, but it is currently hampered by the inability to store locally on your iPod, and has a dismal 64kbps bit rate. If this changes, then it will somewhat negate this advantage for the Zune, but the 10 songs per month will still be a big plus in Zune Pass' favor.

The Zune concentrates on being a Portable Media Player. Not a web browser. Not a game machine. Maybe in the future it'll do even better in those areas, but for now it's a fantastic way to organize and listen to your music and videos, and is without peer in that regard. The iPod's strengths are its web browsing and apps. If those sound more compelling, perhaps it is your best choice.

The new Zune browser is surprisingly good, but not as good as the iPod's. It works well, but isn't as fast as Safari, and has a clunkier interface. If you occasionally plan on using the web browser that's not an issue, but if you're planning to browse the web alot from your PMP then the iPod's larger screen and better browser may be important.

政治家にとっては１が大切です。
もともと、立法は議会の仕事です。政治家が自分の作った法律について知らない方がおかしいのです。（本当は役人が作ったのですが。苦笑）
ですから、「彼らと同じ土俵」で政治家が勝つのが当然なのです。
次の文章をお読みください。
● 総務省は、十年間もインターネットの選挙利用を妨害した責任を取るべきである ――総務省はこっそり公職選挙法の解釈を変えている
法律が変わっていないのに、十年前は閉鎖させられていたホームページが公開できるようになりました。それは、総務省が法律の解釈を変えたからです。現状では、行政にこのような大きな裁量権があるのです。しかし、こんなに大きな裁量権が行政にあること自体が間違っているのです。
役人が恣意的に法律を解釈して、現実を歪めているのです。
このような現状を改めなくてはいけません。
それを論じたのが次の文章です。

議会が法律を定めたのです。ですから、政治家はその解釈についてもよく知っているはずです。（本当は、役人の方がよく「知って」いるのですが。苦笑）

しかし、その関係が逆転している。
それが大きな問題です。
市民にとっては２も大切でしょう。「クビが危ないぞ、という責め方」は特に大切です。（笑）
役人が好き勝手な解釈をしているのは「クビ」にならないからです。上の文章で論じたように、役人に不当な法解釈の責任を取らせるべきです。
役人が責任を取らされるようになれば世界は変わるでしょう。

はじめてコメントします。おっしゃるように、総務相の態度は職務放棄としか思えませんね。また、小役人は自分の手が届く範囲でしか考えず、かつ自分が責任を負わないように振る舞うので、「当然解釈」ができないのでしょう。彼らと同じ土俵で、細かい技術論になると、水掛け論にしかなりません。もっと「上位の」規範を持ち出して、それに反したら、クビが危ないぞ、という責め方はどうでしょうか？たとえば、せっかく公職法１条で「日本国憲法の精神に則り」と明言しているのですから、紛らわしい名称の政党の存在によって、憲法上保障された「選挙権」（憲法15条）が侵害された、したがって当該選挙は無効となる（公選法204条）、という「解釈」は可能ではないかと思います。また、そのような違憲状態になることを予測しながら、「政治団体」の指定を行った選挙管理委員会および総務大臣に対して、行政不服審査法にもとづく申立を行うことも可能になるような気がします。いずれにせよ、真っ向から、役所の「解釈権」に反対することはとても重要だと思います。素人考え、失礼しました。
