私の入学した高校には奇妙な校則があった。
次のものである。
覚醒剤は使用してはならない。
この校則は、どう奇妙なのか。
「覚醒剤は使用してはならない」のは当たり前のことである。当たり前のことをわざわざ書く必要はない。誠に奇妙である。
このような当たり前のことを取り立てて校則で書くのは問題である。次のように解釈される恐れがあるからである。
このような当たり前のことをわざわざ書くところを見ると、書いていないことはしていいのだろう。例えば、万引きなどはしてもいいのだろう。
校則とは学校の「法律」である。一般社会の法律に反することをしてはいけないのは、既に前提とされている。前提は書く必要はない。
書く必要の無いものを書くと、上のような解釈が生じてしまう。つまり、「書いていないことはしていい」という解釈である。
一つだけを｢してはならない」と強調すると、他のことは｢してもいい」という解釈を生じさせてしまう。
実は、現行法にも同様の事例がある。法曹関係者にはよく知られた事例である。
日本国憲法第三十六条である。（注１）
公務員による拷問及び残虐な刑罰は、絶対にこれを禁ずる。
この条文には｢絶対に」とある。しかし、他の条文にはそのような文言は無いのである。
例えば、第二十九条である。
財産権は、これを侵してはならない。
この条文には｢絶対に」とは書いていない。
つまり、第三十六条だけが強調されているのである。当然、次のような解釈が生じてしまう。
財産権は少しくらい侵してもいいんだ。万引き（窃盗）などはしてもいいのだろう。
一部だけを強調すると、他の部分は重要でないという解釈が生じる。
｢解釈」と書いたことに注目いただきたい。
法律は解釈するものなのである。

ってなっているけれど,
これをそこまで強調するのか…
というくらいの内容に
なってしまった現代です。
面白い校則の表現。
