二つの政党が同じ略称を使うのは問題である。有権者の意志が正確に選挙結果に反映されなくなる。もちろん、これは公職選挙法の趣旨に反する。
そして、現在の公職選挙法においても「同一略称」は禁じられていると解釈した方が自然なのである。
次の文章で詳しく論じた。
● 略称｢日本」問題を分析する ２ ――総務省の公職選挙法の解釈は正しいか
現在の公職選挙法も｢同一略称」を禁じていると解釈できるのである。
しかし、４月１６日の会見で原口一博総務相は次のように言った。
今の法律では止める手だてはない。
疑問がある。
原口一博総務相は、自分で公職選挙法の原文を読んだのか。自力で法律を解釈したのか。
次のような状態なのではないか。
総務相の役人が、原口一博総務相に「今の法律では止める手だてはありません。」と言う。
そして、原口一博総務相は、それを信じて会見で同じように発言する。
よくあることである。
しかし、そうでない可能性もある。原口一博総務相自身が公職選挙法を解釈した可能性もある。その場合、原口一博総務相は自分が公職選挙法をどう解釈したかを示すべきであろう。（注１）
次の批判に答えるべきであろう。
１ 政党ではない政治団体は「同一略称」を禁じられている。それなのに、なぜ政党には認められるのか。
２ 政党が「同一略称」を使ってはいけないのは当たり前のことである。明文規定が無いのは、当たり前だから書かなかっただけである。（注２）
３ 公職選挙法の趣旨は、｢公明」｢適正」な選挙制度の確立である。その趣旨から見て、政党についても「同一略称」は禁じられていると解釈するのが自然である。
このような批判に前もって答えておくべきなのである。
しかし、原口一博総務省は何もしなかった。
もしかしたら、原口一博総務相は法律を解釈するという発想自体をもっていないのかもしれない。
それならば、次の文章をお読みいただきたい。
● 「法律を解釈する」という発想
法律とは解釈するものなのである。
自分に都合よく法律を解釈することで、現実を操作することが可能なのである。だから、法律は自力で解釈しなくてはならない。そして、どちらの解釈が正しいのかを争わなくてはならない。
役人は法律の解釈を独占することによって、権力を持っているのである。影響力を持っているのである。
「政治主導」という概念がある。しかし、政治家が役人の法解釈をうのみにしている限り、そのような状態は実現しない。
政治主導とは、政治家が法律を解釈することである。
法律の解釈を通して、現実を変えることである。
政治主導とは役所から法律の解釈権を奪うことなのである
政治家は、役人から「今の法律では出来ない」と言われるであろう。しかし、それは本当か。自力で法律を解釈しなくてはならない。別の解釈で役人の解釈を圧倒しなくてはならない。その解釈によって現実を変えなくてはならない。
原口一博総務相は正にそれをするべき立場にいるのである。
原口一博総務相には私の文章の存在を「つぶやいて」おいた。私の解釈をよく読んでもらいたい。そして、自分の解釈で判断をくだしてもらいたい。（注３）

この文章の事例と｢同一略称」の事例とを比較すると発想が広がるはずである。
しかし、今はその時間がない。

この文章を書き終わってから、政府が「同一略称」を｢受理せざるを得ない」と判断したという事実が報道された。これで二つの政党が「日本」という同じ略称になってしまった。残念である。

さらに残念なのは、政府や原口一博総務相が自分の解釈を全く述べていないことである。（私にも読み落としがあるかもしれない。述べている事実があればお教えいただきたい。）

Good points…I would note that as someone who really doesn’t comment to blogs much (in fact, this may be my first post), I don’t think the term “lurker” is very flattering to a non-posting reader. It’s not your fault in the least , but perhaps the blogosphere could come up with a better, non-creepy name for the 90% of us that enjoy reading the content .
